1. Definition of Terms and Conditions
These Terms and Conditions (the “Terms”) govern the dealings in the sale of services (the “Services,” as defined below) that can be purchased on the website www.castellobenelli.it (the “Site”) between the Site Owner and the User who uses the Site or purchases Services on the Site.

 
2. Site Owner
The Owner of the Website referred to at. www.castellobenelli.it Magnolia S.r.l. (“Owner” or “Magnolia”), with registered and administrative office in Bologna, via Dal Monte 8, tax code, VAT number and registration number with the Companies’ Register of Bologna: 11405200012, REA BO – 523514, share capital Euro 10,001.01 i.v. contactable at e-mail info@castellobenelli.it

 
3. Services for sale on the Site
The Site is a tool that allows the sale to the public of the following Services, carried out by Magnolia s.r.l. in favor of its clients (individuals and/or groups and/or legal entities, hereinafter, the “Clients”):
1- Guided tours organized in favor of Clients at Castello Benelli (RN) available in Italian language.

 
4. Procedure for the purchase of Services
On the website www.castellobenelli.it it is possibile to access further pages describing the Services having to do with cultural proposals organized by Magnolia s.r.l., information regarding the time and place of meeting, description of the Services included in the rate, the purchase button with details of the rate, expressed in euros. To initiate a purchase order for one or more Services on the Site, the Customer shall click on the “Buy” button and follow the guided procedure for filling out the order form, which shall be considered, for all legal purposes, as a contractual proposal made by the Customer to Magnolia s.r.l. which shall express its acceptance according to the terms indicated in art.5 below.

To complete the order form, the Customer must provide his or her personal information and payment details, which will be processed in accordance with what is stated in the Privacy Policy available on the Site.

By clicking on the “Continue” button, the Client expresses his/her acceptance of these Conditions of Sale, which can be reached from a link located at the bottom of the home page of the Site.

The services related to the provision of audioguides and guided tours, inherent to the visit of Castello Benelli, are exempt from VAT, pursuant to Article 10, first paragraph, no. 22) of Presidential Decree 633/1972, and the issuance of the invoice is not mandatory unless requested by the Client, pursuant to Article 22, first paragraph, no. 6) of Presidential Decree 633/1972, and are not subject to the obligation of tax certification pursuant to Article 2, paragraph 1, letter n), of Presidential Decree 696/1996

 
5. Methods of payment
The Site uses third-party services (JotForm, Stripe Payments UK Ltd) for payment processing and, therefore, does not record credit card details (such as but not limited to: credit card number, cardholder name, validity date). Should the holder of each such third-party instrument refuse to authorize payment, the order form will not be completed and, therefore, the related purchase will not be completed.
The submission of the order form is deemed to have been sent and, therefore, the purchase of the relevant Services will be confirmed only upon receipt of the automatic confirmation e-mail from castellobenelli.it containing the purchase summary. The purchase confirmation e-mail must be produced before the start of the purchased visit or activity. No admission tickets or tickets will be mailed to the User’s residence and/or domicile and/or home address.

 
6. Minor contract
Since this is a small contract, as defined by Article 47 paragraph 2 of Legislative Decree No. 206 of October 6, 2005 (the so-called “Consumer Code”), the Customer is not entitled to the right of withdrawal; except in the case provided for in Article 7 below, after making the transaction, it is therefore not possible to cancel or change the purchase of the Service.


7. Cancellation of the visit
Services purchased on the Site may be cancelled by Magnolia s.r.l. due to particularly adverse weather conditions or force majeure. In such case, Customers will be notified by e-mail and/or telephone and will be entitled to a full refund of the Service or, at Customer’s option, a bonus equal to the same value of the Purchased Services expendable on the Site for the purchase of any Service.

 
8. Copyright
All trademarks, figurative or nominative, and all other signs, trade names, service marks, word marks, trade names, illustrations, images, logos appearing on the Site concerning Magnolia s.r.l. are and remain the exclusive property of the Owner or its licensors and are protected by applicable trademark laws and relevant international treaties.
It is possible to reproduce the texts and trademarks of the Site by requesting the written permission of Magnolia s.r.l. by sending a request to the email info@castellobenelli.it.


9. Treatment of personal data
Information about the processing of the Customer’s personal data can be found on the page containing the Privacy Policy of the Site.

10. Changes
Magnolia s.r.l. reserves the right to change or update these Terms and Conditions as a result of, among other things, the introduction of new laws or regulations and to provide notice thereof on the Site. The updated Terms and Conditions are effective as of the date of posting on the Site shown at the bottom of these Terms and Conditions.

 
11. Applicable law and jurisdiction
These Terms and Conditions are subject to Italian law and in particular to Legislative Decree No. 206/2005 with respect to distance sales and to Legislative Decree No. 70/2003 with respect to certain aspects of electronic sales. Any and all disputes relating to this Agreement and/or the use of the Site or the purchase of Services on the Site shall be subject to the exclusive jurisdiction of the Court of Bologna.

 
12. Resolving disputes online
In accordance with Article 14 of Regulation (EU) No. 524/2013, the Controller informs Users that it is possible to settle out-of-court disputes concerning contracts concluded with companies for the ‘purchase of goods and services made online by connecting to the ODR telematics platform, which can be reached at https://webgate.ec.europa.eu/odr.
